Résumé

Le présent projet de thèse traite du courant de pensée qui est celui du transhumanisme par le biais du droit international. Les transhumanistes revendiquent l'amélioration de l'homme et de l'espèce humaine grâce à l'augmentation des capacités physiques, mentales et reproductrices de l'homme. Ils souhaitent recourir tant à des technologies déjà existantes ainsi que d'encourager le développement de nouvelles technologies permettant de parvenir à l'augmentation de l'homme et de l'espèce humaine. Ainsi, se pose la question de la modification du corps humain et de l'amélioration de l'espèce humaine en droit international. Le droit international envisage la modification du corps humain par le droit à la santé, le droit de soigner le corps, mais aussi par le « droit » de réparer le corps. Le corps malade ainsi que le corps infirme se voit saisi par le droit international. On aborde la modification de l'état du corps humain et du corps humain lui-même à travers le « droit » aux médicaments ainsi que l'abus des substances psychotropes et des stupéfiants, mais aussi par le biais du droit à la prothèse et, à titre exemplaire, par le dopage technique dans le cadre d'une compétition sportive. Le présent projet de thèse, aborde aussi l'amélioration de l'espèce humaine, sous ses diverses formes, tel que le clonage, l'eugénisme, les atteintes à l'humanité, la sélection des caractéristiques génétiques de l'homme ainsi que la modification du génome humain.

Résumé

The present thesis deals with human enhancement versus international law. Transhumanists claim the improvement of man and the human species by increasing physical, mental and reproductive capacities of the human. They wish to make use of existing technologies as well as to encourage the development of new technologies to achieve their goals. Thus, there is the question of the modification of the human body and the improvement of the human species in international law. International law deals with the modification of the human body by the right to health, the right to heal the body, but also by the "right" to repair the body. The sick body and the disabled body are seized by international law. The modification of the state of the human body and of the human body itself is addressed through the "right" to medicines as well as the abuse of psychotropic substances and narcotics, but also by addressing the right to prosthesis and, as an example, by addressing technical doping in the sports. This project also deals with the improvement of the human species, in its various forms, such as cloning, eugenics, attacks on humanity, the selection of the genetic characteristics of man and the modification of the human genome.
