La codification en droit international privé : une perspective universaliste en matière de conflit de lois ?

Résumé

Since the second half of the twentieth century, the proliferation of written sources of private international law has revealed the existence of a codification movement. In order to codify this branch of law, international codification, i.e. unification by means of international treaties, is preferred. Such a choice is explained by the purpose of private international law, which is to regulate legal relationships with an element of foreignness. However, international codification does not unsettle the various national regulations of private international law; most States have their own codification. This duality of codification exalts the doctrinal controversy between universalists and particularists in matters of conflict of laws. Universalists consider that private relationships that have an element of foreignness must receive a universal response, while particularists believe that such reports require a national response. This opposition is fraught with consequences as it means that the conflict-of-laws provisions, although unified by means of international treaties, remain a projection, at the international level, of domestic civil law. Since these domestic civil rights are very heterogeneous, international codification is not able to meet the main objective of private international law, which is to ensure the continuity of legal situations throughout the world. The study of the codification movement in private international law seeks to overcome this opposition and to prove that national codification contributes to the establishment of universal solutions to conflict of laws. If this is the case, the confrontation between universalism and particularism could give way to the complementarity of the "methods" of codification. To find out, a comparative examination of a sample of national and supranational codifications is necessary in an attempt to identify "common models" for the regulation of international private relations. This comparative examination will make it possible to understand the reasons for the survival of national codification and to demonstrate that, like international codification, it can promote the creation of universal solutions in relation to conflict of laws.
Depuis la seconde moitié du XXème siècle, la prolifération des sources écrites du droit international privé révèle l’existence d’un processus de codification. Pour codifier cette branche du droit, la codification internationale c’est-à-dire l’unification par voie de traités internationaux est privilégiée. Un tel choix s’explique par l’objet du droit international privé qui est de réglementer les rapports de droit présentant un élément d’extranéité. Pour autant, la codification internationale ne supplante pas les différentes réglementations nationales du droit international privé ; la plupart des États possèdent leur propre codification. Cette dualité de la codification exalte la controverse doctrinale qui oppose, en matière de conflit de lois, les universalistes aux particularistes. Les universalistes considèrent que les rapports privés qui présent un élément d’extranéité doivent recevoir une réponse universelle tandis que les particularistes estiment que de tels rapports requièrent une réaction nationale. Cette opposition est lourde de conséquences puisqu’elle signifie que les dispositions relatives au conflit de lois, bien qu’elles soient unifiées par voie de traités internationaux, restent une projection, sur le plan international, du droit civil interne. Ces droits civils internes étant très hétérogènes, la codification internationale n’est pas en mesure de répondre à l’objectif principal du droit international privé qui est d’assurer la continuité des situations juridiques à travers le monde. L’étude du processus de codification en droit international privé cherche à dépasser cette opposition et à prouver que la codification nationale participe à l’établissement de solutions universelles en matière de conflit de lois. Si c’est le cas, la confrontation entre universalisme et particularisme pourrait céder devant la complémentarité des « méthodes » de codification. Pour le savoir, il faut procéder à un examen comparatif d’un échantillon de codifications nationales et supranationales pour tenter d’en dégager des « modèles communs » de réglementation des rapports privés internationaux. Cet examen comparatif permettra d’appréhender les raisons de la survivance de la codification nationale et de démontrer, qu’à l’image de la codification internationale, elle peut favoriser la constitution de solutions universelles en matière de conflit de lois.
