Résumé

The constitutional control over laws system is considered to be the most important guarantee in protecting the constitution and its human rights and freedoms. In fact, it has finally been established even among the staunchest opponents of this system.The emergence of constitutional control over laws system can be traced back to the decision of the English judge, Thomas Claude, when he refused to implement a law that he saw as inconsistent with Magna Carta Document 1215. He considered it to be the highest legal base in the country, and to represent a commitment to the king and Parliament. However, the famous Malbury v. Madison ruling by Justice Jack Marshall of the United States Supreme Court in 1803 was regarded as the first implementation of the constitutional control over laws system. After the French Revolution, Sieyès sought to transfer the system to the French constitution and suggested exercising it away from the judicial authority.The constitutional control over laws system was established in Libya in 1951 by articles 151 to 158 of the independence constitution, which determined its practice by the Supreme Court. However, the Supreme Court establishment law No. 12/1953 and its internal regulations issued on January 9, 1954 specified how to practice this system in terms of "conditions and procedures in two ways: the direct lawsuit and the defence of unconstitutionality etc., and the judgment issued by the court was given an absolute and binding argument for all". Thus, both constitutional and ordinary legislators have adopted this system, but its application has been a source of contention among some jurisprudence and state institutions, with some rejecting it and others accepting it. This has been revealed by the first practice of this system on the occasion of the appeal against the royal order regarding the dissolution of the Legislative Council of the western Tripoli region. The Supreme Court had concluded that the dissolution of the council was unconstitutional. However, Law No. 6/1982 abolished constitutional control over the legal system, which was then restored by Law No. 17/1994. Despite the difficulties, the Supreme Court has been able, through the exercise of this system, to address many of the legislations that violated the constitution and its principles of human rights and freedoms. This insistence on implementing the system affirms the importance of this system in protecting the constitution and its principles.However, Libya has suffered from a lack of effective and organized institutions, which quickly vanished and resulted in divisions after parliamentary elections in 2014. The Libyan elections were subjected to a constitutional challenge regarding the unconstitutionality of the seventh constitutional amendment related to the amendment of paragraph 11 of Article 30 of the 2011 Constitutional Declaration. The Supreme Court ruled that the amendment was unconstitutional. However, the elected parliament and its government rejected and the outgoing National Congress exploited the court ruling and returned to power, which complicated the matter and entered the country into a phase of chaos and institutional division. On May 11, 2016, the General Assembly of the Supreme Court issued Resolution No. 7/2016 suspending the consideration of constitutional disputes, and this situation continued until the date of writing this thesis.
Le contrôle constitutionnel sur les lois est la garantie la plus importante pour la protection de la constitution et des droits et libertés qu'elle contient. Ce fait a même été établi parmi les opposants les plus farouche à ce système. L'émergence du système de contrôle constitutionnel des lois remonte à la décision du juge anglais Claude Lotus lorsque celui-ci a refusé d'appliquer une loi qu'il considérait comme incompatible avec le document intitulé Magana Carta daté de 1215. Il le considérait comme supérieur à la règle en vigueur dans le pays et un engagement envers le roi et le parlement. Cependant la jurisprudence considère la fameuse décision du juge Marshall de la cour suprême des Etats Unis rendue en 1803 dans le procès intenté par Malbury V Madison comme la première application importante de ce système. Après la révolution française le juriste Sieyès demandait le transfert du système de contrôle constitutionnel dans la constitution française et suggérait qu'il soit exercé en dehors du pouvoir judiciaire. Le système de contrôle constitutionnel des lois en Libye a été établi en vertu de la constitution de son indépendance de 1951, les articles- 151 à 158 précisent sa pratique par la cour suprême, comme la loi portant création de la cour suprême n°12/1953. Le règlement intérieur du tribunal suprême établi le 01/09/1954 et ses amendements ont montré comment pratiquer ce système en terme de conditions et procédures. Le système est exercé par deux actions : l’action direct et l’action exception. Le jugement rendu par la cour suprême été accordé un argument absolu et contraignant pour tous. Ainsi les législateurs constitutionnels et ordinaires ont adopté ce système, mais son application a été un sujet de litige entre le rejet et l'acceptation par une certaine jurisprudence et un certain nombre d'institutions. Cela a été révélé lors de la première utilisation du système à l'occasion du recours contre l'arrêté royal relatif à a dissolution du conseil législatif de la région ouest de Tripoli. La cour suprême a conclu que la dissolution du dit conseil était inconstitutionnelle, puis cette compétence a été abrogé par la loi n°6/1982 puis rétablie par la loi n°17/1994 et malgré les difficultés rencontrées dans l'exercice du système de contrôle constitutionnels des lois, la cour suprême a pu par la pratique de ce système s'attaquer à de nombreuses législations qui violaient la constitution et son principe des droits de l'homme et des libertés. En fait la Libye manquait d'institutions efficaces et organisées qui se sont rapidement estompées et scindées suite aux élections législatives de 2014 elles ont fait l'objet d'une contestation constitutionnelle devant la cour suprême. Cette contestation concernait l'absence de constitutionnalité du 7ème amendement constitutionnel relatif a l'amendement- du paragraphe 11 de l'article 30 de la déclaration constitutionnelle de 2011 qui a jugé qu'il était inconstitutionnel. Le parlement élu et son gouvernement l'a rejeté, le congrès national sortant a exploité cette décision et son retour au pouvoir ce qui a encore compliqué les choses et a fait entrer le pays dans une phase de chaos et de division. Le 5/11/2016, l'assemblée générale de la cour suprême a adopté la résolution n°7/2016 suspendant l'examen des contestations constitutionnelles et cette situation s'est poursuivie jusqu'à l'heure actuelle.
