Résumé

L’externalisation de la gestion du domaine public a pour objectif de promouvoir une gestion plus dynamique des propriétés publiques. La valorisation du domaine public nécessite ainsi la mise en œuvre de schéma de financement spécifique entre personnes privées et personnes publiques. Les instruments financiers jusqu’alors mis en œuvre sur le domaine public sont issus du droit privé. Cependant, ils se sont émancipés de leurs modèles d’origine pour se conformer à des régimes adaptés au cadre de la domanialité publique et aux contraintes impliquées par la spécificité du domaine public et des principes qui les régissent. L’étude des mécanismes de crédit-bail administratif, de location avec option d’achat et d’hypothèque administrative permet d’analyser les composants nécessaires au financement sur le domaine public. Une notion simplifiée et plus homogène du « contrat financier domanial » pourra alors être mise à jour : il s’agira de clarifier la situation des contrats financiers utilisés sur le domaine public en montrant comment les mécanismes de droit privé ont évolué afin de répondre à des besoins issus du régime exorbitant du domaine public

Contract with financial object and economic valuation of the public domain

Résumé

The outsourcing of the management of the public domain has for objective to promote a more dynamic management of the public properties. The valuation of the public domain requires the implementation of specific financing plan between private and public persons. The financial instruments until then operated on the public domain arise from the private law. However, they became emancipated of their models, to conform to the system adapted to the public domain framework and to the legal requirement implied by the specificity of the public domain and the principles which govern them. The study of the mechanisms of different administrative property leasing and administrative mortgage allows analyzing components necessary for the financing on the public domain. Then a more homogeneous and simplified notion of the " state-owned financial contract " can be find, it will be a question of clarifying the situation of the financial contracts used on the public domain by showing how the mechanisms of private law evolved in this context.
