Résumé

Traditionnellement, état civil et volonté individuelle sont deux notions antinomiques. Les éléments de l'état civil ne pouvaient faire l'objet de modifications. Pourtant, la matière de l'état civil n'a pu échapper à l'emprise croissante de la volonté individuelle qui s'immisce progressivement, influençant ses diverses composantes. L'état civil semblant inadapté à l'intervention de cette nouvelle donnée se métamorphose. Il se renouvelle tant par sa nature d’ordre public que par sa fonction d'identification sociale et intègre désormais la volonté individuelle. La définition de l'état civil suppose donc une actualisation par l'intégration de la notion d'identité plus appropriée puisqu'elle prend en compte l'aspect objectif d'identification sociale impliquant une certaine stabilité et l'aspect subjectif autorisant les modifications permettant la réalisation d'un équilibre entre intérêts individuels et intérêts sociaux.

Résumé

Traditionally, civil state and individual will are two antinomies concepts. The component of civil state could not be subject to amendment. Yet, the content of civil state could not break away the increasing thrall of the individual will, which involve itself progressively in, impacting its various components. Civil state, seeming unprepared to the arriving of this new piece of data, has to transform itself. It renews itself indeed by its nature of law and order as well as by its social designation function and from now on integrates the individual will. Therefore, the definition of civil state assumes a realization by integrating the concept of identity which is more fitted since it takes in consideration the objective aspect of the social identification implying a definite constancy and the subjective aspect allowing the amendment which will enable the achievement of a balance between self-interests and social interests.
