Résumé

La transplantation d’organes est un aspect du problème général de la disposition du corps d’un vivant ou d’un cadavre. Les greffes d’organes supposent le prélèvement, donc une atteinte sur le corps. Sur le plan individuel, la transplantation d’organes crée un conflit d’intérêt. La greffe d’un organe si elle est nécessaire pour sauver la vie ou la santé d’une personne, suppose que l’on prélève cet organe sur le corps d’une personne saine mettant ainsi sa santé en danger. Ce sont ces conflits qui créent des problèmes juridiques. La recherche consiste dans la question de savoir pourquoi et dans quelle mesure les transplantations d’organes, véritables atteintes au corps, sont permises.

Résumé

The organ transplantation is an aspect of the general problem of the provision of the body of alive [a living body] or a corpse. The organ transplantation suppose the taking away, therefore an attack on the body. On the individual level, the organ transplantation creates a conflict of interest. The organ transplantation it is necessary to save the life or the health of a person, supposes that one takes this body on the body of a healthy person thus endangering his health. These are the conflicts which create legal problems. Research consists in the question of knowing why and up to what point organs transplantations, true attacks with the body, are allowed.
