Résumé
L'identité juridique est un ensemble de référents naturels et sociaux ayant pour fonction première de distinguer les membres de la société. Or, suivant le développement des droits individuels et fondamentaux, il apparaît que loin de lui être totalement imposée, l'individu peut agir sur son identité tantôt en choisissant certains de ses référents identitaires, tantôt en pouvant participer à leur modification. Mais, surtout, au-delà de sa simple fonction d'individualisation, l'identité participe aussi à la protection des personnes et à travers elles à la protection de l'espèce humaine

The legal identity is whole of natural and social referents having for function firts to distinguish the members from the society. However according to the development of the individual and fundmental rights it appears that far from him to be completely imposed the individual can act on his identity sometimes by choosing some of his referents sometimes while being able to take part in their modification. But especially beyond the simple function of individualization the identity also takes part in protection of the people and through them in the protection of the mankind
