Résumé
L'acte à personne indéterminée est l'acte qui dès l'origine, lors de sa formation, a pour destinataire de ses effets fondamentaux, une personne qui n'est pas directement déterminée quant à son individualité et identité mais qui est susceptible de l'être par le détour d'une qualité, d'une condition, d'une élection ou d'un événement. Le domaine de l'acte à personne indéterminée révèle que certains le sont « par décision » alors que d'autres le sont « par définition ». Ils se caractérisent par un objet original qui en fait des actes attributifs ; par une problématique spécifique quant à la détermination du destinataire des effets des actes. Problématique qui pousse les juges du fond à jouer un rôle exorbitant en ce qu'ils dépassent fréquemment la limite de leur pouvoir d'interprétation.

The deed with anybody unspecified is the act which dice the origin, at the time of its formation, has as a recipient of its fundamental effects, a person who is not directly determined its individuality and identity but which is likely to be it by the turning of a quality, a condition, an election or an event. The field of the act to anybody unspecified reveals that certain are it "by decision" whereas others are it "by definition". They are characterized by an original object which in fact of the deeds of assignment; by specific problems as for the determination of the recipient of the effects of the acts. Problems which push the courts dealing with the substance of a case to play an exorbitant part in what they exceed the limit fréquement to them to be able of interpretation.
