Résumé

Cette thèse concerne les problèmes juridiques liés à la protection de l' environnement et plus particulièrement la pollution des sols. Elle montre que l' organisation du droit autour de cette problématique s' explique par le concept de fait juridique de pollution des sols. Il en ressort que l' analyse des problèmes de pollution des sols exige une certaine reformulation du droit notamment dans ses aspects méthodologiques, tant sur le plan pratique que théorique. Elle conclut sur le fait que toute une oeuvre de jurisprudence reste à mener à bien, tant en droit privé que public, où le juge sera amené à jouer un rôle déterminant.

Résumé

This thesis is concerned with the juridical problems associated with the protection of the environment and, more specifically, with the pollution of the soil. It demonstrates that the organization of the law regarding those questions is cleary dependent upon that concept. It follows that the analysis of the problems associated with soil pollution calls for a certain new reformulation of the law, notably with regards to its methodological aspects, in pratical as well in theoretical terms. This thesis concludes on the acknowledgment that there is an important jurisprudential task to be carried out in the field of public as well as in private law where the judge will have to assume a determining role.
