Résumé

Le délégué médical est le suppôt essentiel de l'information médicale. Le seul texte juridique qui définit sa profession est l'annexe visiteur médical de la convention collective nationale de l'industrie pharmaceutique. Le délégué médical ne possède ni diplôme d'état ni statut. Les laboratoires pharmaceutiques utilisent cet informateur comme un représentant et lui imposent des objectifs de "vente" alors qu'il n'exerce aucune activité commerciale. Cette incitation à faire prescrire les médecins induit une augmentation de la consommation pharmaceutique et a un effet pervers sur les finances de l'assurance-maladie. Malgré plusieurs essais de règlementation de la profession, le délégué médical reste un salarie de droit commun. A l'horizon 1993 quel va être son devenir au sein de la communauté européenne? Afin d'assurer une information de qualité, on pourrait envisager de désolidariser l'information médicale des industriels de la pharmacie en créant un office national de l'information médicale.

The representative in pharmatical products is the essential support of the medical information. The only legal text defening his profession is the appendix to the national collective convention of the pharmaceutic industry. The representative in pharmaceutical products has neither state diplome her statute. The pharmaceutic laboratories use this information as one representative and impose him sale's objects though he is not a seller; this incitement to compel the doctors to prescribe induce an increase of the pharmaceutica consumtion and has a perverse result on the finances of the disease insurance. In spite of several trials for regulatery the profession of representative in pharmaceutical products still remain a wage-garner subject to common law. In 1993 what is his tuture in european community? In order to supply a good information it is possible to considerer the separation of the medical information from the pharmaceutic industry in establishing a national office of medical information.
