Résumé

Si on compare la conception de la souverainete en occident et en chine, on sera frappe par ce contraste: en occident, les theories concernant ce sujet sont extremement abondantes, tandis qu'en chine, les idees sur la souverainete sont vraiment rares et simplificatrices. Ceci est du a leurs differences de tradition politique. Les chinois, en gardant un fort attachement a leur propre conception du pouvoir, sont peu sensibles a la conception occidentale de la souverainete. La propre conception de la souverainete en chine apparait en deux versions la souverainete spirituelle et la souverainete temporelle. La premiere marque une periode ou le pouvoir central est fort, stable et concentre a l'extreme; la seconde traduit une situation dans laquelle le gouvernement central est affaibli, l'unicite du pouvoir est remplacee par sa multiplication. Dans la premiere partie de notre these, nous analysons les caracteristiques de la souverainete spirituelle et de la souverainete temporelle. La deuxieme partie sera consacree aux analyses des constitutions de la dynastie qing et de la republique populaire de chine

Sovereignty in chinese constitutional law

Résumé

If we compare the idea of sovereignty in western countries and in china, we are struck by the following contrast: in western countries, theories concerning sovereignty are numerous whereas in china they are rare and oversimplifying. This is due to the difference in political traditions. Being deeply attached to their own idea of power, the chinese are hardly affected by the western idea of sovereignty. The chinese idea of sovereignty appears along two lines: spiritual sovereignty and temporal sovereignty. The former pervades a period when central power is strong, stable, and extremely concentrated; the latter reflects a situation in which central power has beau weakened the uniqueness of power has beau replaced by its multiplicity. In the first part of this thesis, we will analyse the characteristics of spiritual sovereignty and of temporal sovereignty. The second part will be devoted to an analysis of the various constitution of the qing dynasty and of the people's republic of china.
