Résumé

L'ouvrage tend a mettre en evidence le particularisme des contrats passes par un epoux, qu'ils soient conclus avec le conjoint ou avec un tiers. Le phenomene constate est une veritable alteration du concept de contrat, tel que l'entendent la theorie generale des obligations comme le droit des contrats speciaux. Cette alteration se traduit par une modification, un changement de l'etat du contrat, qui peut meme se transformer en denaturation quand certains principes directeurs, comme l'autonomie de la volonte ou l'effet obligatoire, sont transgresses. Meme dans cette hypothese, aucun jugement de valeur n'est porte, la transformation pouvant fort bien se justifier par les imperatifs du droit matrimonial. Dans une premiere partie ("point de vue analytique"), le phenomene est envisage de maniere parcellaire, par une approche successive de plusieurs aspects du contrat (acte de volonte, de prevision, acte licite et legitime). Dans une seconde partie ("point de vue synthetique"), une explication globale est proposee. Elle est recherchee dans la theorie des systemes. De par le mariage, un systeme matrimonial vient se superposer au systeme patrimonial propre a toute personne (titulaire necessairement d'un patrimoine), et entre en conflit avec lui. L'alteration du contrat est un des produits de ce conflit, resolu comme en droit international prive par appel a des regles de rattachement figurant dans le statut fondamental d'epoux, appele communement regime primaire.

The alteration of the matrimonial contract (a study of the relationship of contract and matrimonial relations )

Résumé

This study tends to point out the specificity of contracts entered into by married people, be it with their spouses or with third parties. A drastic alteration of the concept is observed, be it by reference to the general theory of obligations or to th law relating to specific contracts. This can lead to a change of the state of the contract, or even to denaturation when some basic principles like the will theory or the binding force of contract are infringed. But even in this case, no judgment is borne, as the rationale for such transformations may dwell in the imperatives of matrimonial law. The phenomenum is first envisaged from an analytical point of view, in a minute approach of several aspects of contract, seen in turn as the expression of a will, anticipation, lawful and legitimate act. Then, in a synthetic approach, an overall explaination is proposed within the theory of systems. Due to the marriage, a matrimonial system superimposes and conflicts with the patrimonial system. The alteration of the contract, as a result of this conflict, finds a remedy in rules akin to conflict of laws rules, belonging to the fundamental matrimonial status, known in the french legal system as the "regime primaire".
