A new kind of cryptographic and distributed evidences is emerging within the framework of the law of evidence: blockchain evidences. The rules derived from ordinary law may easily apply to the complex and iconoclastic mechanisms of blockchain evidences. More than that, specific statutes already expressly take into account and recognize blockchain evidences, specifically regarding certain financial securities. However, sticking points and incompleteness remain. In order to reveal the cryptographic truth provided by these evidences, to offer more security while using them, and to serve the courts usefully, the development and implementation of major international principles relating to blockchain evidences, and soft law mechanisms, would allow this new kind of evidences to expand. At the same time, the jurisdictional approach to this new arsenal of evidence is cautious and there are high expectations on the work of court officers. The technical complexity of these evidences may explain why the judges are struggling to recognize and accept them. Therefore, courts’ jurisdiction and independence should be strengthened: proposals on this topic need to be discussed.

  • Résumé

    L'objectif de la thèse, intitulée « La décentralisation territoriale en Roumanie à l’aune de son histoire administrative depuis 1859. Entre rupture et continuité » est, en premier lieu, de faire redécouvrir l’héritage doctrinal relatif au système administratif local roumain. Ensuite, nous analyseront les différents projets mis en œuvre pour une évolution de la décentralisation territoriale en Roumanie, ainsi que d'expliquer la logique dans laquelle s’insèrent ces pas faits. Mais notre objectif est aussi, et surtout, d’apporter une contribution scientifique à un débat actuel en Roumanie, sur la réorganisation juridico-territoriale de l’Etat roumain et de ses collectivités locales. Pour parvenir à cette fin, nous envisageons cette thèse comme une étude approfondie et une analyse détaillée des différents concepts, et en particulier de ceux de la décentralisation territoriale et de l’autonomie locale.

    The aim goal of the thesis, entitled "Territorial decentralization in Romania in the light of its administrative history since 1859. Between rupture and continuity" is, first, to rediscover the doctrinal heritage of the Romanian local administrative system. Then, we will analyze the various projects implemented for a territorial decentralization evolution in Romania, as well as to explain the logic in which these steps take place. But our goal is also, and above all, to make a scientific contribution to a current debate in Romania on the legal and territorial reorganization of the Romanian state and its local authorities. To achieve this end, we consider this thesis as an in-depth study and a detailed analysis of the different concepts, and in particular those of territorial decentralization and local autonomy.
